1. PROMOTION DESCRIPTION

The 2023 76® Dodger Ticket Promotion consists of responding/commenting directly on the Sponsor’s social post(s) on the 76® Facebook (https://www.facebook.com/76gas) and/or Instagram (https://www.instagram.com/76) pages, or entering via email, for a chance to win two (2) tickets to the September 13, 2023 Los Angeles Dodgers regular season home game and two (2) tickets into the VIP 76® Tailgate pre-game event held on-site before the September 13, 2023 Los Angeles Dodgers home game (“Promotion”). 

2. PROMOTION PERIOD

The Promotion begins at 9:00:00 a.m. Central Standard Time (“CST”) on August 24, 2023, and ends at 11:59:59 p.m. CST on September 6, 2023 (“Submission Deadline”). The Sponsor’s computer is the official timekeeping device for the Promotion.

3. ELIGIBILITY

Open to persons who are legal U.S. residents of California, and who are eighteen (18) years of age or older as of August 24, 2023. Employees and the immediate family members (spouses, parents, children, siblings, grandparents, stepparents, stepchildren and stepsiblings and their respective spouses, regardless of where they reside) and household members of each such employee (whether or not related) of Phillips 66 Company (“Sponsor”), Los Angeles Dodgers LLC (“Dodgers”), the other MLB Entities (defined below) and each of their respective parents, affiliates, subsidiaries, retailers, marketers, dealers, advertising agencies, Web designers, and promotion agencies are not eligible to enter or win a prize. Sponsor reserves the right to verify the eligibility of any potential winner. The “MLB Entities” shall mean the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. (“MLB”), Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs (“Clubs”), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities. Void outside California and where prohibited or restricted by law, rule, or regulation.

4. HOW TO ENTER

To enter the Promotion, visit the 76® Gas Facebook (https://www.facebook.com/76gas) and/or Instagram (https://www.instagram.com/76) pages during the Promotion Period and respond/comment directly on the Sponsor’s Promotion entry post.  Alternate Method of Entry: To enter via email, email your full name, street address, city, state, zip code, day and evening telephone numbers (including area codes) and date of birth, and the following statement: “I acknowledge that I have read, understand, and agree to the Promotion Official Rules” to 76social@p66.com with the name of the Promotion (as given above) in the subject line. Incomplete and/or inaccurate entries are void. Sponsor will use email addresses from which entries are submitted for prize notification purposes only. Email entries must be received by the close of the Entry Period to be eligible. Email entries become the property of Sponsor and will not be acknowledged or returned.

5. POST GUIDELINES

Comments/replies must not contain any profanity, nudity, or otherwise offensive content as per the judgment of Sponsor. Any comment or reply that, in Sponsor’s or its representative’s sole and absolute discretion, violates any of the above criteria will be disqualified.

6. LIMITATIONS

Maximum of two (2) entries per person throughout the Promotion Period, one (1) entry per platform. One (1) reply/comment directly on the Sponsor’s Promotion entry post equals one (1) entry on the corresponding platform.  Non-winning entries roll-over to the next Winner Selection Date (defined below).  Any attempt by a person to obtain more than one entry on each platform by posting more than one comment or using multiple or different names, Facebook and/or Instagram accounts, or any other methods may void that person’s entry as solely determined by Sponsor.  In the event of a dispute as to the identity of the winning entry, the entry will be deemed made by the person who posted the submission or entered via email, as determined by Sponsor’s community manager.

7. PRIZES

There will be a total of seventy-five (75) potential winners selected: thirty-seven (37) selected on 08/30/2023 and thirty-eight (38) selected on 09/07/2023 (each date, a “Winner Selection Date”).  Each selected and confirmed winner shall receive the following prize:

• Two (2) tickets for winner and one (1) guest to the September 13, 2023 Los Angeles Dodgers home game and two (2) tickets for winner and one (1) guest into the VIP 76® Tailgate pre-game event being held on-site before the September 13, 2023 Los Angeles Dodgers game (Approximate Retail Value of each prize: $160)
  
  TRANSPORTATION TO/FROM THE GAME, EVENT OR EXHIBITION AND LODGING NOT INCLUDED.
  
  Tickets cannot be redeemed for cash or resold.

Exact nature and duration of the pre-game tailgate shall be determined in the sole discretion of the Dodgers and subject to availability. Use of any Major League Baseball game/event/exhibition ticket is subject to the standard terms, conditions, and health and safety policies applicable to the ticket; see dodgers.com/ticketback for details. Seat locations at the game/event/exhibition and, unless otherwise stated in the prize description, exact game/event/exhibition date shall be determined in the sole discretion of Sponsor. Each winner’s guest(s) must be of legal age of majority in his/her(their) jurisdiction(s) of residence unless accompanied by a parent or legal guardian. Major League Baseball game/event/exhibition dates and times are determined in the sole discretion of the BOC and/or the applicable Club and may be subject to change. The terms and conditions of the tickets awarded as part of any prize will govern in the event a legal game/event/exhibition, as defined by Major League Baseball, is not played or held due to weather conditions, an act of God, an act of terrorism, civil disturbance, or any other reason. Each winner and his/her guest(s) agree to comply with all applicable ballpark and venue regulations in connection with the prize; see dodgers.com/ballpark for details. Sponsor and the MLB Entities reserve the right to remove or to deny entry to any winner and/or his/her guest(s) who engage in a non-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person at the game/event/exhibition. Released Parties (as defined below) will not be responsible for weather conditions; acts of God; acts of terrorism; civil disturbances; local, state, or federal regulation, order, or policy; work stoppage; epidemic, pandemic, or any other issue concerning public health or safety; or any other event outside of their control that may cause the cancellation or postponement of any Major League Baseball game/event/exhibition. Major League Baseball game/event/exhibition tickets awarded as prizes may not be resold, offered for resale, or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and prize forfeiture and may invalidate the license granted by the game/event/exhibition ticket. Participation in the prize event is subject to winner’s (and guest’s) consent to and compliance with all health and safety policies of the MLB Entities, including, but not limited to, the wearing of masks if and when directed and the requirement to be fully vaccinated against COVID-19 (i.e., having received a final vaccination dose at least 14 days prior to the event).

Potential winners are subject to verification of eligibility and compliance with these Official Rules.  Prizes will be fulfilled by email through the MLB Ballpark app by September 13, 2023.  Prizes will be fulfilled by the Sponsor.  Sponsor will not substitute any ticket for another Dodgers home game if a Dodgers home game is unable to take place as scheduled for any reason. 

If a programming, production, seeding, printing or any other reason causes more than the stated number of prizes set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes listed above in accordance with these Official Rules.

8. SELECTION OF WINNERS

Seventy-five (75) potential winners will be randomly selected from the eligible entries received by Sponsor via Sponsor’s Promotion entry posts on Facebook and Instagram, and via email, as explained in Section 7.  Potential winners entering via Sponsor’s Promotion entry post(s) are to follow the Sponsor’s instructions in the applicable Sponsor’s Promotion entry post by the Submission Deadline. Potential winners are eligible to win one (1) prize during the Promotion Period.  Sponsor will notify potential winners on/after the applicable Winner Selection Date via Facebook, Instagram, or email. Each potential winner must respond within twenty-four (24) hours with the following information: full name, and email address associated with the MLB Ballpark app. Method of notification and potential winner’s response is contingent on the method of potential winner’s entry.

Prizes will be distributed through the MLB Ballpark app to the potential winners. If potential winner does not respond to Sponsor’s notification and provide the information as directed above, or the message notification is undeliverable, then potential winner’s entry may be disqualified. Sponsor’s determination of ineligibility or noncompliance with these Official Rules will result in disqualification of the entry. If a potential winner’s entry is disqualified, no alternate potential winner will be selected.

9. GRANTS OF RIGHTS

Each winner by acceptance of a prize hereby irrevocably grants Sponsor, Dodgers, and MLB a non-exclusive, perpetual, royalty-free license to use and display any photo in connection with this Promotion, or related marketing or promotional activities or materials, in any and all media channels, without limitation, worldwide and without additional compensation, notice or approval, unless prohibited by law. Each winner grants Sponsor, Dodgers, and MLB permission to post and/or publish each winner’s name, city/state of residence in connection with any of the above. 

10. GENERAL CONDITIONS

All federal, state and local laws and regulations apply. All federal, state and local taxes are the sole responsibility of each individual winner. No cash equivalent, transfer or substitution of any prize (or portion thereof) is permitted except at Sponsor’s sole discretion.  Prize acceptance constitutes permission to Sponsor, Dodgers, the other MLB Entities and each of their respective agencies and participating retailers to use the recipient’s name and/or likeness for advertising or trade without further compensation in perpetuity, unless prohibited by law. By participating in this Promotion, you agree to be bound by the Official Rules. Material submitted becomes the sole property of Sponsor and will not be returned. Sponsor and MLB shall also have the right to take such other measures as it deems necessary in its sole discretion to preserve the integrity of this Promotion. Released Parties (defined below) are not responsible for (a) lost, late, mutilated, illegible, misdirected, incomplete, or non-delivered mail, posts, text messages or email, or for interrupted or unavailable satellite, network, server, internet service provider, website, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, garbled, corrupted, scrambled, delayed or misdirected transmissions or computer hardware or software or telephone malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information; and (b) any incorrect or inaccurate information, whether caused by website users, or by any equipment or programming associated with or utilized in this Promotion, any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of the website, and (c) any other unforeseeable events. Sponsor and MLB reserve the right, at their sole discretion, to (1) disqualify any individual, who tampers with the entry process or operation of the Promotion, and (2) modify, suspend or terminate all or part of this Promotion. Caution: Any attempt to deliberately damage any website associated with the Promotion or undermine the legitimate operation of this Promotion is a violation of criminal and civil laws, and should such an attempt be made, Sponsor and the MLB Entities reserve the right to seek damages from any person(s) responsible for the attempt to the fullest extent of the law. Released Parties are not responsible for injury or damage to a participant’s or any other person’s mobile phone, computer, tablet or any other entry device related to or resulting from participating in this Promotion.  Released Parties shall not be liable for any circumstances which may prevent the Los Angeles Dodgers game on September 13, 2023 from being played.

11. LIMITATION OF LIABILITY

You agree to release and hold harmless Sponsor, Dodgers, the other MLB Entities, Facebook,  Instagram and each of their respective parents, affiliates, subsidiaries, retailers, marketers, dealers, advertising agencies, web designers, promotion agencies and prize suppliers, and each of their respective officers, directors, shareholders, employees, agents, successors and assigns (collectively, the “Released Parties”) from any and all liabilities, damages, losses, injuries, claims and actions of any kind arising out of or resulting from participation in this Promotion or from the acceptance, use or misuse of any prize or other such benefit including, without limitation, claims based on death, publicity rights, defamation or invasion of privacy. Released Parties are not responsible for incomplete, misdirected, delayed, undelivered, inaccurate, lost, late, garbled, mutilated, illegible entries, postage-due mail, incorrect or inaccurate transcription of entry, electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft, destruction or unauthorized access to or alterations of entry materials, technical, network, telephone equipment, electronic, computer, hardware or software malfunctions, or limitations of any kind or for entries that for any reason are not received by Sponsor by the stated deadline. Released Parties are not responsible for any error or malfunction that occurs during the Promotion, in the announcement of the prizes, in awarding of more prizes than are intended, or in any Promotion-related materials. The Released Parties (i) make no warranty, guaranty or representation of any kind concerning the prizes and (ii) disclaim any implied warranty. 

12. DISPUTES

Except where prohibited, you agree that (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of you and Sponsor in connection with this Promotion, shall be governed by, and construed in accordance with, the laws of the state of Texas, without giving effect to any choice of law or conflict of law rules (whether of the state of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of Texas.

13. YOUR PERSONAL INFORMATION, PRIVACY STATEMENT AND TERMS OF USE

By participating in this Promotion, you hereby agree to Sponsor’s collection and usage of your personal information to (1) contact you by direct message, mobile phone, e-mail, or regular mail for the administration of this Promotion or to allow Sponsor or its select parties to contact you for promotional purposes, (2) better understand the entrants and help Sponsor tailor its communications to you and other entrants, and (3) combine it with other information from and about you. You also hereby agree to Sponsor’s collection and usage of your personal information to contact you by any method made available by you to Sponsor, including regular mail (if applicable), for the administration of this Promotion and prize fulfillment. You acknowledge that you have read and accepted Sponsor’s privacy statement and terms of use. Sponsor will not use or disclose your personal information for any other purpose other than what is stated in these Promotion rules and Sponsor’s privacy statement without your consent. If during the entry process of this Promotion, you have elected to receive (opt-in) communications from Sponsor about future promotions, you may choose to opt-out of such communications at any time upon notice to Sponsor.

14. WINNERS LIST

Any legally required winner’s list may be obtained by sending a self-addressed, stamped envelope after the completion of this Promotion to: The 2023 76® Dodger Ticket Promotion, Winners List Request, P.O. Box 7200, Bartlesville, OK 74005. All such requests must be received by October 11, 2023.
