THE 76® PIN GIVEAWAY PROMOTION 2023 OFFICIAL RULES

The 76® Pin Giveaway Promotion (the “Promotion”) is sponsored by Phillips 66 Company (“Phillips 66” or “Sponsor”).  Los Angeles Dodgers LLC (“Dodgers” or “Los Angeles Dodgers” or “Premium Provider”) is the provider of the commemorative Dodger pin. During the Promotion Period, purchase a minimum of eight (8) gallons of fuel in a single transaction using the Fuel Forward™ App  (the “App”) at a participating southern California 76® gas station to receive the opportunity to redeem for a commemorative Dodger pin, one of two to choose from.

1. PROMOTION PERIOD

12:00:01 AM, PT on August 15, 2023, through 11:59:59 PM, PT on September 30, 2023, while supplies last.

2. HOW TO PARTICIPATE:

1) Purchase a minimum of eight (8) gallons of any grade of fuel in a single transaction with the Fuel Forward™ App  beginning August 15, 2023, through and including September 30, 2023, at a participating southern California 76® gas station/convenience store using the Fuel Forward™ App. If you don’t have the Fuel Forward™ App, you can download it for free from the App store at https://apps.apple.com/us/app/ or Google Play at https://play.google.com/store/apps/.

2) After fuel has been purchased, follow triggered instructions within the Fuel Forward™ App for redemption on the Promotion page (the “Website”).

3) Follow instructions on the Website within the Fuel Forward™ App to receive a commemorative pin. Participants must select their preferred pin design, then input the required information: full name, address, and email in respective fields on the Website.

4) Once the online form has been received electronically, one (1) commemorative pin will be delivered to the participant by Dcember 15, 2023, while supplies last.

Each submission is valid for one (1) of the two commemorative 76 Dodger pins. One (1) pin will be given per submission. Online form must be completed at the Website. These pins will be distributed while supplies last and will be delivered by December 15, 2023. One (1) redemption per person, per day, per transaction, per user account will be accepted, with a maximum of ten (10) redemptions per person during the Promotion Period. First preference pin design will be sent if available. All entries must be submitted according to Official Rules and must be received electronically by deadline of September 30, 2023. Pins obtained through this Promotion may not be sold or used for any commercial or promotional purposes whatsoever.

3. ELIGIBILITY

The Promotion is open only to legal residents of the United States who are eighteen (18) years of age or older (except in the case of legal residents of certain states where the legal age of majority is greater than eighteen (18) years of age, such legal age of majority) as of August 15, 2023. Employees of the Sponsor, the MLB Entities (as defined below), Administrator, Premium Provider, or anyone involved in the production and distribution of materials for this Promotion and their immediate families (i.e., spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) are not eligible to participate. LIMIT ONE (1) redemption PER PERSON PER DAY, PER TRANSACTION, PER USER ACCOUNT DURING THE PROMOTION PERIOD. MAXIMUM OF TEN (10) redemptions per person during the Promotion Period.

4. GENERAL CONDITIONS

Offer good while supplies last. Redemptions that are mechanically or otherwise reproduced will not be accepted. The Sponsor and the MLB Entities are not responsible for printing, typographical errors, or any other errors in any promotion-related materials or administration of the promotion including, but not limited to, errors in advertising and in these Official Rules, or for lost, stolen, misdirected, damaged, incomplete, or illegible redemptions. By participating in the Promotion, each participant accepts and agrees to these Official Rules. The Sponsor reserves the right to change or cancel the Promotion at any time without prior notice. Sponsor and the MLB Entities are not responsible for (a) lost, late, mutilated, illegible, misdirected, incomplete, or non-delivered mail, Redemptions, text messages or email, or for interrupted or unavailable satellite, network, server, internet service provider, website, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, garbled, corrupted, scrambled, delayed or misdirected transmissions or computer hardware or software or telephone malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information; and (b) any incorrect or inaccurate information, whether caused by Website users, or by any equipment or programming associated with or utilized in this Promotion, any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of the Website, and (c) any other unforeseeable events. ANY Redemption THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED A DEFECTIVE Redemption, IS VOID, AND WILL NOT BE HONORED. Sponsor reserves the right, at its sole discretion, to (1) disqualify any individual, who tampers with the entry process or operation of the Promotion, and (2) modify, suspend or terminate all or part of this Promotion. Caution: Any attempt by you to deliberately damage any Website or undermine the legitimate operation of this Promotion is a violation of criminal and civil laws, and should such an attempt be made, Sponsor reserves the right to seek damages from you to the fullest extent of the law. Sponsor is not responsible for injury or damage to a participant’s or any other person’s mobile phone, computer, tablet or any other entry device related to or resulting from participating in this Promotion.

5. PARTICIPANT’S PERSONAL INFORMATION, PRIVACY STATEMENT AND TERMS OF USE

By participating in this Promotion, participants hereby agree to Sponsor and Administrator’s (as defined below) collection and usage of their personal information to verify eligibility or to contact participant by e-mail, phone or regular mail for the administration of this Promotion, and acknowledge that they have read and accepted Sponsor’s privacy statement and terms of use. Sponsor and Administrator  will not use or disclose participant’s personal information for any other purpose without the consent of the applicable participant. If during the entry process of this Promotion, you have elected to receive (opt-in) communications from Sponsor about future promotions, you may choose to opt-out of such communications at any time upon notice to Sponsor.

By participating in this Promotion, you hereby agree to Sponsor’s collection and usage of your personal information to (1) contact you by mobile phone, e-mail, or regular mail for the administration of this Promotion or to allow Sponsor or its select parties to contact you for promotional purposes, (2) better understand you and help Sponsor tailor its communications to you and other Promotion Participants, and (3) combine it with other information from and about you. You also hereby agree to Sponsor’s collection and usage of your personal information to contact you by any method made available by you to Sponsor, including regular mail (if applicable), for the administration of this Promotion and prize fulfillment. 6. LIMITATION OF LIABILITY

By accepting the Promo Codes, entrants agree to release and hold harmless Sponsor, Administrator[RR1] , and their respective parents, affiliates, subsidiaries, retailers, marketers, dealers, advertising agencies, web designers, promotion agencies and suppliers, and each of their respective officers, directors, shareholders, employees, agents, successors and assigns and the MLB Entities (collectively, the “Released Parties”) from any and all liabilities, damages, losses, injuries, claims and actions of any kind arising out of or resulting from participation in this Promotion or from the acceptance, use or misuse of any pin or other such benefit including, without limitation, claims based on death, publicity rights, defamation or invasion of privacy. The “MLB Entities” shall mean the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P., Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs (“Clubs”), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC, and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities. 

Released Parties are not responsible for incomplete, misdirected, delayed, undelivered, inaccurate, lost, late, garbled, mutilated, illegible entries, postage due mail, incorrect or inaccurate transcription of entry, electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft, destruction or unauthorized access to or alterations of entry materials, technical, network, telephone equipment, electronic, computer, hardware or software malfunctions, or limitations of any kind or for entries that for any reason are not received by Sponsor by the stated deadline. Released Parties are not responsible for any error or malfunction that occurs when processing entries, in the announcement of the pin giveaways, mailing of pins, in awarding of more pins than are intended, or in any promotion-related materials. The Released Parties (i) make no warranty, guaranty or representation of any kind concerning the pins and (ii) disclaim any implied warranty.

7. DISPUTES

Except where prohibited, entrants agree that (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will entrants be permitted to obtain awards for, and entrants hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor in connection with this Promotion, shall be governed by, and construed in accordance with, the laws of the state of Texas, without giving effect to any choice of law or conflict of law rules (whether of the state of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of Texas.
